OKLAHOMA CITY, Okla. — Oklahomans will have to wait a little longer to see when they’ll be able to decide whether to legalize recreational marijuana.
The Oklahoma Supreme Court delayed a decision Tuesday but did confirm justices will decide the date it will appear on the ballot.
Supporters of State Question 820 say that’s a win. SQ 820 would legalize, tax and regulate marijuana in Oklahoma without medical cards.
But it’s unclear when it will appear on the ballot. The court is waiting for a 10-day challenge period to end before making a decision.
The Oklahoma State Election Board said the deadline to print ballots for November has passed. But SQ 820 supporters say that if the court rules in their favor after the challenge period, the election board will have to move ahead with the question in November.
“This is an issue that has brought together people that are Republicans and Democrats and Independents from all 77 counties, and ages 18 to 102,” said Michelle Tilley with Oklahomans for Sensible Marijuana Laws.
More than 117,000 people agreed that SQ 820 should go before voters. Supporters say they’ll survive any challenges in their way.
“We feel pretty confident. There’s two possible challenges that could occur in this 10-day period. One is to the signatures and we’ve internally audited and validated those signatures multiple times,” Tilley said. “As far as any challenges to the ballot title, again, we were very pleased with the ballot title that Attorney General John O’Connor wrote.”
But timing could throw a wrench in their plans.
“We’ve always had the goal of being on the November 2022 ballot. So, we are running full steam ahead. Continuing to talk to people about the issue. What we want is for people to get to vote,” she said.
The election board said the deadline to print ballots has passed. They said they couldn’t comment on pending litigation when asked what would happen should the court order the question to appear on the November ballot.
