Ex oficial de transporte de presos es declarado culpable / Former prisoner transport officer guilty of sexually assaulting detainee

TULSA, OK — El ex funcionario de transporte de presos Dewayne Dudley, de 56 años, se declaró culpable ante el tribunal federal del distrito norte de Oklahoma de violar los derechos civiles de un detenido al agredirlo sexualmente y secuestrarlo.

“Las agresiones sexuales perpetradas por funcionarios encargados de hacer cumplir la ley en cualquier fase del proceso de justicia penal, incluido el transporte de detenidos, no tienen cabida en nuestra sociedad”, declaró la fiscal general adjunta Kristen Clarke, de la división de derechos civiles del departamento de justicia. “El Departamento de Justicia seguirá investigando y persiguiendo a los funcionarios encargados de hacer cumplir la ley que abusen de su poder y autoridad”.

Según el acuerdo de culpabilidad, en el momento del delito, Dudley trabajaba como oficial de transporte de prisioneros para Blue Raven Services. Como oficial privado de transporte de prisioneros, Dudley desempeñó la función gubernamental de recoger a las personas que fueron arrestadas con órdenes judiciales fuera del estado y transportarlas de regreso a las jurisdicciones que emitieron las órdenes judiciales. El 26 de agosto de 2021, Dudley recogió a la víctima, un hombre detenido, de una cárcel en Boonville, Indiana, para transportarlo a Valencia, Nuevo México.

El 27 de agosto de 2021, antes de llegar a Nuevo México, Dudley detuvo la camioneta de transporte en un Holiday Inn Express, situado en Marshfield, Misuri, donde alquiló una habitación. Dudley llevó al detenido esposado a la habitación del hotel y le dijo que se duchara. Después de que la víctima se duchó, Dudley le apuntó con una pistola y le obligó a desnudarse. Dudley procedió entonces a manosear los genitales del detenido, luego Dudley se esposó a la víctima, antes de irse a dormir. Varias horas después, Dudley reanudó el transporte con la de detener la camioneta en su apartamento (de Dudley), situado en Claremore, Oklahoma. En contra de las protestas del detenido, Dudley llevó a la víctima esposada al interior de su apartamento. Mientras estaba dentro de su apartamento, Dudley volvió a manosear los genitales del detenido, causándole lesiones corporales. La víctima dijo “¡No!” y pudo liberarse y salir corriendo del apartamento de Dudley.

Aún no se ha programado una audiencia para dictar sentencia. Según el acuerdo de culpabilidad, Dudley se enfrenta a entre 12 y 15 años de prisión federal, seguidos de hasta cinco años de libertad supervisada. Además, deberá indemnizar a la víctima.

“Dewayne Dudley se aprovechó de su posición de autoridad cuando agredió cruelmente a un detenido al que debía proteger”, declaró el agente especial a cargo Edward J. Gray, de la oficina del FBI en Oklahoma City. “La declaración de culpabilidad de hoy demuestra el compromiso del FBI de preservar la confianza en las fuerzas del orden. No toleraremos que funcionarios públicos violen los derechos constitucionales de nuestros ciudadanos”.

Former prisoner transport officer guilty of sexually assaulting detainee

TULSA, OK — Former prisoner transport officer, Dewayne Dudley, 56, pleaded guilty in federal court in the Northern District of Oklahoma to violating a male detainee’s civil rights by sexually assaulting and kidnapping him.

“Sexual assaults carried out by law enforcement officials at any stage of the criminal justice process, including in the transport of detainees held in custody, have no place in our society,” said Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division. “The Justice Department will continue to investigate and prosecute law enforcement officials who abuse their power and authority.”

According to the plea agreement, at the time of the offense, Dudley worked as a prisoner transport officer for Blue Raven Services. As a private prisoner transport officer, Dudley performed the government function of picking up individuals who were arrested on out-of-state warrants and transporting those individuals back to the jurisdictions that issued the warrants. On August 26, 2021, Dudley picked up the victim, a male detainee, from a jail in Boonville, Indiana, to transport him to Valencia, New Mexico.

On August 27, 2021, before arriving in New Mexico, Dudley stopped the transport van at a Holiday Inn Express, located in Marshfield, Missouri, where he rented a room. Dudley brought the handcuffed victim into the hotel room and told him to shower. After the victim showered, Dudley pointed a gun at the victim and told him to undress. Dudley then proceeded to grope the victim’s genitals. When the victim’s penis did not erect, Dudley handcuffed himself to the victim, before going to sleep. Several hours later, Dudley resumed transporting the victim, before stopping the transport van at his (Dudley’s) apartment, located in Claremore, Oklahoma. Against the victim’s protests, Dudley brought the handcuffed victim inside his apartment. While inside his apartment, Dudley again groped the victim’s genitals, causing the victim bodily injury. The victim said, “No!,” and was able to break free and run outside of Dudley’s apartment.

A sentencing hearing has not been scheduled yet. Pursuant to the plea agreement, Dudley faces 12 to 15 years in federal prison, to be followed by up to five years of supervised release. In addition, Dudley must pay restitution to the victim.

“Dewayne Dudley exploited his position of authority when he cruelly assaulted a detainee he was charged to protect,” said Special Agent in Charge Edward J. Gray for the FBI Oklahoma City Field Office. “Today’s guilty plea demonstrates the FBI’s commitment to preserving trust in law enforcement. We will not tolerate public officials who violate the constitutional rights of our citizens.”
