Aumentan los arrestos en Tulsa / ICE arrests increasing in Tulsa

La administración Trump ha dejado bien en claro que su guerra contra los indocumentados recién empieza. Ciudades emblemáticas como Nueva York, Denver y Chicago han sido testigos de redadas y arrestos masivos. Y en Los Ángeles la oleada de protestas se hace sentir, indicando que son tiempos turbulentos.

Tulsa, lamentablemente, no es la excepción a la regla. Según la abogada Lorena Rivas se están registrando cada vez más arrestos en la ciudad. “Hemos visto un incremento del 50% en la cantidad de detenidos y las demandas en las cortes para solicitar fianza”, declaró.  

“En OKC se detuvieron a personas que estaban en una gasolinera, si bien no conocemos los detalles, sabemos que están siendo más agresivos en los controles de ICE para crear miedo en la comunidad”. “Muchos tienen antecedentes criminales y deportaciones previas pero otros no”, aseguró Rivas.

En el condado de Tulsa el programa 287(g) vincula a la oficina del sheriff con el ICE, lo que obliga a las fuerzas de seguridad a indagar el status inmigratorio de quienes son arrestados por delitos criminales y entregarlos a la agencia. 

“Están deteniendo personas indocumentadas, pero se las detiene por cargos criminales y luego se descubre su status inmigratorio en las cárceles de Tulsa. A los indocumentados se los pone en ‘ICE hold’ luego de ser detenidos”, recalcó la abogada. 

Recientemente se consiguió vetar a la infame ley HB4156, que buscaba criminalizar el status de los indocumentados, sin embargo, el gobernador de Oklahoma y el procurador general continúan impulsando la contienda anti inmigrante. 

“La ley buscaba criminalizar a los indocumentados por su condición de ilegales, los obligaba a pagar multas y los deportaba. Pero con ACLU Oklahoma presentamos una demanda con los padres unidos de Tulsa para que no entre en efecto porque la ley era anti-constitucional porque el poder de detener personas y deportarlas por su status inmigratorio le pertenece al poder federal”, dijo la abogada.

“Por suerte, el juez federal del Western district opinó igual que nosotros, el estado apeló la decisión y hasta el momento continúan las tratativas. Pero al menos sabemos que la policía del sheriff hoy no puede detener personas y deportarlas por su condición inmigratoria”, dijo Rivas.

Rivas asegura que aún hay esperanzas, porque en relación al resto del país, Oklahoma es un lugar seguro. “Somos un estado rojo, y esta administración se focaliza en Chicago, NY, Denver, California, los estados azules a quienes quiere castigar, por eso no creo que vaya a haber por ahora redadas grandes. Lo bueno es que en Tulsa el alcalde está a favor de los inmigrantes y la policía también. El sheriff, a su modo, comprende que los recursos son para víctimas del crimen, no para gastar en cuestiones inmigratorias. Pienso que estamos más protegidos aquí que en otras partes del país, pero si supongo que las detenciones van a continuar”, agregó. 

La abogada afirmó a su vez que el gobierno federal está utilizando diversas estrategias para detener a la mayor cantidad posible de inmigrantes. “El primer foco son los inmigrantes que entraron con asilo hace menos de dos años, con ellos se aplica un expedit removal. Luego están los que ingresaron con parole humanitario, que tienen fecha de vencimiento. Si esos status temporales de residencia TPS no se renuevan, esa gente puede convertirse en indocumentada y ser removida.”, explicó.

La situación es crítica, pues el pánico que se está generando hace que muchos opten por no continuar con sus trámites de asilo y otros vuelvan a sus países de origen para evitar complicaciones. 

“Aunque es triste lo que estamos viviendo,  me da esperanza  ver que la gente está entendiendo que la manera en la que se conduce esta administración no es humanamente correcta. Trato de mantenerme positiva por mis clientes porque si los abogados no peleamos las batallas, entonces, no las peleará nadie”, dijo. 

A todos los inmigrantes allí afuera Rivas les pide tengan esperanza, dejen su miedo atrás y recuerden las siguientes palabras:  “ Tu vida es valiosa, tú eres un miembro de esta comunidad y de los Estados Unidos, sepan que hay oportunidades y hay que seguir luchando, siempre”. (La Semana)

The Trump administration has made it very clear that its war against undocumented immigrants is only just beginning. Iconic cities like New York, Denver, and Chicago have witnessed raids and mass arrests. And in Los Angeles, waves of protests are being felt, signaling turbulent times.

Unfortunately, Tulsa is no exception. According to attorney Lorena Rivas, arrests are increasingly being reported in the city. “We’ve seen a 50% increase in the number of detainees and in court petitions for bond hearings,” she stated.

“In OKC, people were detained at a gas station. Although we don’t know all the details, we know that ICE is being more aggressive in its checks to instill fear in the community. Many have criminal records and prior deportations, but others do not,” Rivas added.

In Tulsa County, the 287(g) program links the sheriff’s office with ICE, requiring law enforcement to inquire about the immigration status of those arrested for criminal offenses and turn them over to the agency. “They are detaining undocumented people, but they’re initially arrested on criminal charges, and then their immigration status is discovered while in Tulsa jails. Once detained, the undocumented are placed under an ICE hold,” the attorney emphasized.

Recently, the infamous HB4156 law — which sought to criminalize undocumented status — was successfully blocked. However, the governor of Oklahoma and the attorney general continue to push their anti-immigrant agenda. 

“The law aimed to criminalize undocumented immigrants simply for their illegal status, forcing them to pay fines and be deported. But with ACLU Oklahoma, we filed a lawsuit alongside Tulsa United Parents to prevent it from taking effect, because the law was unconstitutional — the power to detain and deport individuals based on immigration status belongs to the federal government,” the attorney explained.

“Fortunately, the federal judge from the Western District agreed with us. The state has appealed the decision, and discussions are ongoing. But at least for now, the sheriff’s police cannot detain and deport people based solely on immigration status,” Rivas said.

Rivas remains hopeful, noting that compared to the rest of the country, Oklahoma is relatively safe. “We are a red state, and this administration is focusing on Chicago, NY, Denver, California — the blue states it wants to punish. That’s why I don’t believe there will be large-scale raids here for now. The good thing is that in Tulsa, the mayor supports immigrants, and so does the police. The sheriff, in his own way, understands that resources should be used for crime victims, not spent on immigration matters. I believe we are more protected here than in other parts of the country, though I do think detentions will continue,” she added.

The attorney also stated that the federal government is using various strategies to detain as many immigrants as possible. “The first target is immigrants who entered under asylum less than two years ago, for whom expedited removal is applied. Then there are those who entered with humanitarian parole, which has an expiration date. If those temporary residence statuses like TPS aren’t renewed, those individuals could become undocumented and be removed,” she explained.

The situation is critical, as the growing panic is leading many to abandon their asylum processes, while others are returning to their home countries to avoid complications.

“Although it’s sad what we are experiencing, I find hope in seeing that people are starting to understand that the way this administration is acting is not humane. I try to stay positive for my clients, because if the lawyers don’t fight these battles, no one else will,” she said.

To all immigrants out there, Rivas urges them to have hope, set aside their fear, and remember these words: “Your life is valuable, you are a member of this community and of the United States. Know that there are opportunities, and we must continue fighting, always.” (La Semana)
