El enfoque duro y a menudo cruel de los años de Trump no fomentó tal dilema ético, dado que era poco probable que una administración que se deleitaba públicamente en arrancar a los niños llorando de los brazos de sus madres aterrorizadas perdiera un minuto de sueño por el hacinamiento de las condiciones en los centros de detención en los que los menores estaban a la espera de su colocación con miembros de la familia.

Pero todo eso cambió cuando Joe Biden juró como presidente a principios de este año. Incluso los oponentes políticos de Biden a lo largo de los años generalmente están de acuerdo en que, Biden, por encima de todo,  es un hombre decente con empatía por los demás, y esta fuerza de carácter se ha visto confirmada en su trato a los migrantes y refugiados, en particular a los niños. Ya no se obliga a los menores no acompañados a regresar a México, donde tenían que vivir en condiciones peligrosas e insalubres. En cambio, están siendo admitidos en los Estados Unidos, pero la gran cantidad de jóvenes desesperados ha abrumado a un sistema que ya tenía una capacidad limitada, todo lo cual contribuyó a las imágenes angustiosas de niños durmiendo bajo mantas de aluminio sin una distancia segura entre ellos.

Sin embargo, a diferencia de la situación durante la administración anterior, estas condiciones son mucho más temporales y se está realizando un esfuerzo titánico para colocar a los niños con miembros de la familia lo antes posible. Uno de los primeros cambios de política de la administración Biden fue eliminar la amenaza de arresto y deportación que enfrentan las posibles familias anfitrionas bajo Trump. Los miembros de la familia ya no están siendo examinados para determinar el estado de residencia como condición para acoger a los niños migrantes, lo que pronto debería comenzar a aliviar la congestión en las instalaciones de detención del Departamento de Seguridad Nacional (DHS).

Aunque a nadie le gusta ver a los niños detenidos, grupos de defensa de los inmigrantes como el National Immigration Law Center (NILC) están elogiando a la administración Biden por nombrar a personas para puestos clave que pueden ayudar a lograr el cambio tan necesario en nuestro fracturado sistema de inmigración.

“La administración Biden continúa señalando su compromiso no sólo de deshacer los daños de la última administración, sino también para hacer realidad un sistema de inmigración del siglo XXI que tenga sus raíces en la justicia y que honre la dignidad y las contribuciones de los millones de inmigrantes que llaman a este país su hogar” dijo la directora ejecutiva del NILC, Marielena Hincapié, después de que Biden nombrara al ex subdirector del NILC, Kamal Essaheb, como consejero del secretario del DHS, Alejandro Mayorkas.

Es cierto que los proyectos de ley de reforma migratoria aprobados recientemente en la Cámara de Representantes de los Estados Unidos enfrentan una batalla cuesta arriba en el Senado, pero el hecho de que Estados Unidos esté mostrando ahora un rostro más amable y humano a quienes buscan refugio en este país está siendo visto como un primer paso fundamental para restaurar la fe a aquellos que fueron rechazados y vilipendiados durante los cuatro años anteriores. Biden shows USA’s kinder face to migrants

Recent weeks have seen a surge in the number of unaccompanied minor children seeking refuge at the US-Mexico border, presenting the United States government with a unique and difficult set of challenges, first among them being how to grant so many of these children safe harbor, while doing so in a manner that respects their rights as refugees and fellow human beings.

The heavy-handed and often cruel approach of the Trump years fostered no such ethical dilemma, given that an administration that publicly delighted in tearing crying children from the arms of their terrified mothers was unlikely to lose a minute’s sleep over how crowded the conditions were in holding facilities where the minors were kept pending placement with family members.

But all of that changed when Joe Biden was sworn in as president earlier this year. Even Biden’s political opponents over the years generally agree that, above all else, Biden is a decent man with empathy for others, and this strength of character has been borne out in his treatment of migrants and refugees, particularly children. No longer are unaccompanied minors being forced back into Mexico, where they had to exist in dangerous and unsanitary conditions. Instead they are being admitted to the United States, but the sheer number of desperate youth has overwhelmed a system that already had limited capacity, all of which contributed to the distressing images of children sleeping under foil blankets with no safe distance between them.

However, unlike the situation during the previous administration, these conditions are far more temporary, and a herculean effort is being undertaken to place children with family members as quickly as possible. One of the Biden administration’s first policy changes was to remove the threat of arrest and deportation faced by potential host families under Trump. Family members are no longer being screened for residency status as a condition of taking in the migrant children, which should soon begin to alleviate congestion in Department of Homeland Security (DHS) holding facilities.

While no one likes to see kids detained, immigrant advocacy groups such as the National Immigration Law Center (NILC) are praising the Biden administration for appointing people to key positions who can help bring about badly needed change in our broken immigration system.

“The Biden administration continues to signal its commitment not only to undoing the harms of the last administration, but also to bringing to fruition a 21st century immigration system that is rooted in fairness and that honors the dignity and contributions of the millions of immigrants who call this country home,” NILC Executive Director Marielena Hincapié said after Biden named NILC’s former deputy director Kamal Essaheb as counselor to DHS Secretary Alejandro Mayorkas.

It is true that immigration reform bills recently passed in the US House of Representatives face an uphill battle in the Senate, but the fact that the United States is now showing a kinder, more human face to those who look to this country for refuge is being seen as a critical first step in restoring faith to those who were shunned and vilified during the previous four years.
